MIST is no longer available on the App Store, but MIST+ remains available to existing users.

Privacy

MIST prioritizes your privacy and operates with minimal data collection. Most features operate entirely on your device. No personal data is collected or stored on the app and the server, and no analytics or tracking tools are used.

MIST+ Chat Feature

By using the MIST+ chat functionality, you agree to this privacy policy. OpenAI API is used exclusively for the MIST+ chat functionality. MIST do not log, store, or retain any chat conversations on the server, and OpenAI API logging is disabled on the developer’s account. Children’s Privacy

MIST should be suitable for users of all ages. It does not knowingly collect personal information from children under 13. Parents can contact us to request deletion of any child’s data. If you are a parent and you believe that your child has provided personal information to MIST, please contact so that the developer can delete the data.

IP Address Logging

For security purposes, your IP address may be temporarily stored in memory on our server only when using the MIST+ chat functionality. This data is used strictly for maintaining the security and integrity of our service and is never used to identify or track individual users.

Changes to This Policy

If MIST make any changes to the privacy practices in the future, this policy will be updated accordingly. Changes will be reflected in the “Last Updated” date.

Terms

The Terms of Service for MIST (hereinafter referred to as “these Terms”) are as follows: These Terms are the Terms of Service for MIST provided by Nao Enomoto (hereinafter referred to as “the Company”). These Terms are a contract between the user of MIST (hereinafter referred to as “the User”) and the developer of MIST (hereinafter referred to as “the Company”), and establish the conditions for the use of MIST by the User. The User must understand and agree to the contents of these Terms before using MIST.

Subscription

Auto-Renewal: MIST+ is a monthly subscription service priced at $1.99 that provides enhanced features including advanced chat functionality, standby mode, and personalized experiences with the MIST character.

Restoration: You can restore your MIST+ subscription on any device using the same Apple ID through the app’s restore purchases feature.

Price Lock: Price changes will not affect your current billing period. As long as you maintain an active subscription, your price will remain unchanged. However, if you cancel and resubscribe later, the new price will be applied. Price changes may occur outside of the app due to compliance with local taxes, currency fluctuations, or regulatory requirements.

Refunds: We do not provide refunds for MIST+ subscriptions. All refund requests must be submitted through Apple’s App Store refund process. Please contact Apple Support for assistance with subscription refunds.

Acceptable Use

You agree to use MIST+ features responsibly and appropriately. You must not use the chat feature to generate harmful, offensive, or inappropriate content, attempt to reverse engineer or modify the MIST app, use the service for any illegal activities, or share your subscription with others.

Privacy and Data Protection

Chat Data: When using MIST+ chat functionality, your messages are sent to OpenAI’s API for response generation. We do not log, store, or retain any chat conversations on our servers. OpenAI may retain chat data for up to 30 days for abuse monitoring.

Personal Information: Your username is stored locally on your device and is used solely for personalization features. No personal data is collected or stored on our servers.

Service Availability

Internet Connection: MIST+ Chat features require an active internet connection to function properly.

Technical Issues: We strive to maintain high service quality but cannot guarantee uninterrupted access to MIST+ features.

Intellectual Property

Third-Party Fonts: The MIST app uses the DSEG font family created by Keshikan (けしかん), which is licensed under SIL Open Font License 1.1. The DSEG font copyright belongs to Keshikan and not to nao enomoto. The font is available at https://www.keshikan.net/fonts.html and is used for digital display elements within the app.

Limitation of Liability

AI Responses: While we strive to provide appropriate responses, we cannot guarantee the accuracy, appropriateness, or usefulness of AI-generated responses. Users should exercise their own judgment when interpreting MIST’s responses.

Termination

By You: You may terminate your MIST+ subscription at any time through your App Store account settings.

By the Company: We may terminate or suspend your access to MIST+ features if you violate these terms or engage in inappropriate use of the service.
